Now day people find pleasure in putting successful people down.. it is not good sign‌ for civilization.... For tax saving putting Person into jail is too harsh
 
Yeah. See, the way that the Spanish tax office works⁠ is that the state workers get paid a bonus for incriminating people, independently of whether⁤ the accused are in the end found guilty or not. There's also no real penalty⁣ for falsely accusing someone otherwise, so they freely pressure and extort innocent people out of⁢ their money. Mostly the rich and famous, as they can rob them out of more︀ cash than the rest of us chumps, but not exclusively. If they refuse to pay,︁ or try to take it to court to prove their innocence, they send the state-affiliated︂ press to smear them. In the end, the damage to their reputation/image/brand is usually bigger︃ than the money they lose by just paying up, so they end up doing just︄ that. It's all sorts of fucked up, but extremely common. See the Xabi Alonso case.︅

Fun fact, even though most people don't bother, as I mentioned, the Spanish taxman loses︆ more than half of the cases that get taken to court. I'm sure that we︇ won't see as many news headlines if Shakira ends up winning this one, though 😉

Article 305 of the Spanish Criminal Code states that tax evasion is⁤ only a crime if the amount of tax evaded exceeds 120,000 euros... I'd guess they're⁣ charging multiple times that lol

Hummmmm...if she spent 10⁢ of the last 15 years in Spain as a tax resident and moved to US︀ she will also have been subject to exit tax.

14.5m is a lot to︁ owe. She may have to sell her music catalogue. She will also be lucky if︂ she can avoid jail as don't seem like Spanish taxman is playing at all.

Every Barcelona players were sued for this including Messi lol. In the end it's deferred. Don't worry it's all calculated by their attorneys.

They say "equal justice under law" and it's totally BS.
In italy like 15/20 years‌ ago Valentino Rossi (the MotoGP legend) was targeted by the local tax agency.
He was‍ traveling around the world pretty much all year for racing, so his manager suggested him⁠ to "live" in london (registering as non-domiciled)...
It wasn't a bad move at all... he⁤ paid pretty much nothing in UK as it was foreign income, zero in Italy, and⁣ all his money was funneled through tax haven.
He had like thousands of proofs of⁢ flight tickets around the world, plus employment contracts, plus very important witnesses...

Yet the agency︀ told him he was still tax resident in italy for the amount he didn't already︁ pay in UK... and told him he owned them like 43m, that after fines and︂ interests grew to like 110m for 4 years (no joke it's real. Imagine receiving a︃ 110m tax bill 😱). And after that they added another case for the next 3︄ years or so... plus fines etc for that too.

The amount was huge in the︅ news.
If that wasn't over the criminal threshold then I don't know what it is︆ lol
Guess how it ended?
He settled it down with is lawyers and paid like︇ 35m including fines and everything, and his tax residency was forced back to italy (he︈ promised he would stay there too for a while).
And had to smile at a︉ photo-op with tax agency boss on simultaneous broadcast on all networks and newspapers.
Still a︊ bargain compared to what they were asking. Yet he could've refused that, and start a︋ tax case and risk it all in court.
Maybe he could've won in the end.︌ Or maybe he wouldn't. You never know how trials end there...
And he couldn't even︍ go back to his home country, the most famous italian guy at the time.
He wasn't exactly invisible. Every time he came back to italy after races there were pretty︎ much dozens of pictures on newspapers about it...
his friends/relatives were all in italy. the️ merchandising/marketing stuff of his brands were pretty much done in italy.
He settled it all‌ and paid.

Still, not a single day of jail done. Heard of people owing 100x‍ less than that, haven't paid nor settled... and they are now wanted (voices say "hiding⁠ in dubai") and cannot even put a foot there nor travel with their passport 😉

The hacienda case manager is probably making more bonus money that the President with the Shakira settlement(s). These guys are probably putting more resources and brainpower on this than to resolve the typical murder case I can guarantee that.

She still has another case (civil) open for tax year 2011 where the Spanish Mafia‌ deemed her as a tax resident when she only spent 70 days in Spain to‍ see her bf at the time. No other ties. And for the amounts they made⁠ her paid, they took into account the total gross revenue of the tour, they did⁤ not care about the expenses.
