Yeah. See, the way that the Spanish tax office works is that the state workers get paid a bonus for incriminating people, independently of whether the accused are in the end found guilty or not. There's also no real penalty for falsely accusing someone otherwise, so they freely pressure and extort innocent people out of their money. Mostly the rich and famous, as they can rob them out of more cash than the rest of us chumps, but not exclusively. If they refuse to pay, or try to take it to court to prove their innocence, they send the state-affiliated press to smear them. In the end, the damage to their reputation/image/brand is usually bigger than the money they lose by just paying up, so they end up doing just that. It's all sorts of fucked up, but extremely common. See the Xabi Alonso case.

Fun fact, even though most people don't bother, as I mentioned, the Spanish taxman loses more than half of the cases that get taken to court. I'm sure that we won't see as many news headlines if Shakira ends up winning this one, though 😉

Article 305 of the Spanish Criminal Code states that tax evasion is only a crime if the amount of tax evaded exceeds 120,000 euros... I'd guess they're charging multiple times that lol

The sentence facing Shakira​

In the event that no agreement is reached, the Colombian singer would face, before this second case, a sentence of eight years and two months in prison.

That is the requested sentence from the Prosecutor's Office. However, as reported by Europa Press after consulting different legal sources, the scenario could be very different in the event that the artist agrees with the Treasury and recognizes the alleged fraud.

For now, the Colombian has fought the cases. In fact, in several public statements, she has expressed her disagreement with the efforts from the Prosecutor's Office.

Her lawyers pointed out that her fiscal conduct has always been "impeccable" and recalled that they have "never" had problems of this type "with any other jurisdiction".


Shakira believes she has been "persecuted" by the Treasury even in the seasons in which, according to her legal team, she did not spend "even 60 days in Spain".

Shakira criticized the public body in her recent song with Bizarrap, saying: "You left me as a neighbor to the mother-in-law, with the press at the door and the debt in Hacienda".

Hummmmm...if she spent 10 of the last 15 years in Spain as a tax resident and moved to US she will also have been subject to exit tax.

14.5m is a lot to owe. She may have to sell her music catalogue. She will also be lucky if she can avoid jail as don't seem like Spanish taxman is playing at all.

Every Barcelona players were sued for this including Messi lol. In the end it's deferred. Don't worry it's all calculated by their attorneys.

Didn't realize she had such an alleged networth and earned so much money in her career eek¤%&. Your right. She has money so will pay. I had in my head she was already rinsed dry by Spanish taxman and would struggle to settle. But now I can see the Spanish taxman salivating at a financial settlement as she has $$$$.

They say "equal justice under law" and it's totally BS.
In italy like 15/20 years ago Valentino Rossi (the MotoGP legend) was targeted by the local tax agency.
He was traveling around the world pretty much all year for racing, so his manager suggested him to "live" in london (registering as non-domiciled)...
It wasn't a bad move at all... he paid pretty much nothing in UK as it was foreign income, zero in Italy, and all his money was funneled through tax haven.
He had like thousands of proofs of flight tickets around the world, plus employment contracts, plus very important witnesses...

Yet the agency told him he was still tax resident in italy for the amount he didn't already pay in UK... and told him he owned them like 43m, that after fines and interests grew to like 110m for 4 years (no joke it's real. Imagine receiving a 110m tax bill 😱). And after that they added another case for the next 3 years or so... plus fines etc for that too.

The amount was huge in the news.
If that wasn't over the criminal threshold then I don't know what it is lol
Guess how it ended?
He settled it down with is lawyers and paid like 35m including fines and everything, and his tax residency was forced back to italy (he promised he would stay there too for a while).
And had to smile at a photo-op with tax agency boss on simultaneous broadcast on all networks and newspapers.
Still a bargain compared to what they were asking. Yet he could've refused that, and start a tax case and risk it all in court.
Maybe he could've won in the end. Or maybe he wouldn't. You never know how trials end there...
And he couldn't even go back to his home country, the most famous italian guy at the time.
He wasn't exactly invisible. Every time he came back to italy after races there were pretty much dozens of pictures on newspapers about it...
his friends/relatives were all in italy. the merchandising/marketing stuff of his brands were pretty much done in italy.
He settled it all and paid.

Still, not a single day of jail done. Heard of people owing 100x less than that, haven't paid nor settled... and they are now wanted (voices say "hiding in dubai") and cannot even put a foot there nor travel with their passport 😉

The hacienda case manager is probably making more bonus money that the President with the Shakira settlement(s). These guys are probably putting more resources and brainpower on this than to resolve the typical murder case I can guarantee that.

She still has another case (civil) open for tax year 2011 where the Spanish Mafia deemed her as a tax resident when she only spent 70 days in Spain to see her bf at the time. No other ties. And for the amounts they made her paid, they took into account the total gross revenue of the tour, they did not care about the expenses.

Don't give those socialists an inch, otherwise they'll use it to destroy you, and can personally confirm this being true.
Sadly many are too kind with them... don't be too generous with them when you spot one.
This starts from small daily things to taxes, to laws etc.
You give them a small thing for free and they are already planning how to steal the next bigger one off you...
Treat them poorly right from the start. I found it works just fine and they'll find the next one to milk...
(aka get out of EU and stop paying taxes there and feeding the beast...)
