I am setting up a Gibraltar company, all my clients are US based and will be B2B transactions for software services.

One thing that worries me is that from what I understand nonresident are taxed at 30% in US and a W-8BEN form is required which might make the company exempt from this witholding according to the two countries tax treaty.

However from what I understand Gibraltar and US do not have a tax treaty...
Can someone help me make sense of this?

Non residents are only taxed at 30% if you don't give them a w8ben to prove you are non us resident. No tax treaty needed (for services).
Withholding taxes would apply on royalties.
