Belarus as an option for no CRS and the OECD convention on mutual administrative assistance in tax matters

Yes, permanent residence is harder to get. I think one need to stay for 5 years on a temporary or something similar. However, Russia does have CFC rules (quite aggressive) and is part of the CRS and OECD Convention.

Belarus as an option for no CRS and the OECD convention on mutual administrative assistance in tax matters

This is a link to the law in Russian: https://zakony-by.com/zakon_rb_o_pr...annyh_grazhdan_i_lits_bez_grazhdanstva/48.htm It says that it is given to people that own "residental premises" but limited to one year. It is not stated how much money you need to spend, it is considered on a case by...

Substance over form law and structures

But here the problem is the same. You sell company shares but did you just create a company in order to achieve this tax benefit? In that case the 'substance over form' law can be used against you if the company got no substance.

Substance over form law and structures

Because you are using a structure to lower your taxes if your company got no other activities than investing into the stock market for you

Belarus as an option for no CRS and the OECD convention on mutual administrative assistance in tax matters

It seems like this is official, just not specifically made for buying real estate but more broad.

Belarus as an option for no CRS and the OECD convention on mutual administrative assistance in tax matters

True, although I heard that it is possible to get residence permit by buying property for $30k-50k and having an attractive western passport. It is not an official program, but there was a guy on Youtube claiming that this is how it works in practice and I have seen other sources on it as well...

Belarus as an option for no CRS and the OECD convention on mutual administrative assistance in tax matters

I want to start by saying that I am really trying to do everything legal but I also value my privacy. The point here is not to evade taxes but to take advantage of the possibility of better privacy. Belarus has been discussed in another thread regarding investing. But, I wanted to bring Belarus...

Substance over form law and structures

I mentioned this in another thread so I thought about creating a new one. I see a lot of examples of structures where the only benefit is achieving lower tax. But, there is also a 'substance over form' law in many countries. How can it be legal to structure companies in these ways? For...

Opening an LLC in either Estonia or Latvia and living there. Please help me decide.

Yes, I see. But for Latvia, I was wondering if crypto to crypto transactions were tax free only for individuals or for corporations as well. Even if it is not, obviously crypto is gonna rise faster than shares. So it would be a tactical move to hold crypto as an individual and trade with...

Yes, corporate. Is this true for corporations as well or only individuals?

@rust3964 Did you end up making a move on this one? Estonia is raising income tax to 24% from next year.

Estonia Corporate Tax: to pay or not to pay?

However, to the point 2) of the law you sent, in Estonia even a PE is considered to be a CFC. Does that mean that a US LLC is a PE and therefore a CFC and pays tax on all profits regardless if distributed or not?

Question offshore company for investing in crypto/stock market

Im completely new to all of this and learning. Found out about tax advantages in Estonia after making this post. However, I found some information that that a PE is not taxed on any foreign sourced income in Estonia while an Estonian company is only taxed on undistributed profits. Im not sure...

Estonia Corporate Tax: to pay or not to pay?

You are completely right! Thanks! I also read this: "In Estonia, resident companies are taxed on profits distributed from their worldwide income, while PEs of non-residents are taxed only on profits distributed from income derived from Estonian sources." Is it really true that PEs are never...

Estonia Corporate Tax: to pay or not to pay?

Don, I really appreciate your help. It seems like you know a lot about this field. But I guess I am still new to all of this. 1. In case the US LLC is deemed to be a PE, all profits would be tax free as income from trading stocks would be considered foreign sourced income, right? 2. Can you...

Estonia Corporate Tax: to pay or not to pay?

So if I settle in Estonia and open a US LLC to trade stocks, is there a risk for it to be considered a CFC instead of a PE? Why, why not? And if it considered to be a CFC, how would it be taxed?

Estonia Corporate Tax: to pay or not to pay?

Why would all CFC undistributed profits be taxed at PIT rates? Shouldn't a CFC have the same treatment as an Estonian company, that is, tax free undistributed profits?
