Opening LLC in Delaware makes you U.S person ?

Hi all,

I am new in this forum , I've been reading a lot here before I decided posting. I would like to thank you all for this great forum, for everybody's contribution, it is very helpful.

I have a small question, might seem a bit trivial, but I'm not sure.

If I decide to open an LLC in delaware, the bank account would be outside the U.S, (probably Cyprus), would it make me a U.S person in Fatca's eyes ?

I am not a U.S citizen, neither a resident

Yes, FATCA was done for tax evasion prevention, and as a US entity you may have tax obligations.
I'm non US resident having Wyoming LLC and pay zero taxes. IRS system has a lot of holes, there are a lot of tricks 🙂

Thank you very much for your answer. So, it might make my life harder to open bank account etc... better using a Seychelles IBC.

Where did you open a bank account for your Wyoming LLC ? Was it remote ?
 
I'd don't know what's your business nature to advice. But I always advice my mates who are evolved in Ecommerce to incorporate in Europe offshore areas to get merchant accounts.

Regarding the bank account, I use Payoneer.
 
Of course not. Many US companies have European owners, not concerned with FATCA which concerns US citizens only.
 
There are several providers around that can incorporate a Delaware company (just an example) with foreign owner, director and get the whole thing apostilled.
 
Is it harder to open an offshore bank account let say in Cyprus if I have a DE LLC?
Seems to me, bank outside U.S don't like U.S company anymore
