Hi gurus, asking for a dear friend of mine. He sees a divorce coming, not started yet. The main issue is that he is a good worker and entrepreneur, so he has a good reserve. While wife didn't contribute much, not even looking after family. So sharing all in half doesn't seem fair. Any steps anyone can suggest to save some pot somewhere, ot make things a bit more fair?

This answer doesn't surprise me, @JohnnyDoe smi(&% but there's probably not much he can do, OP. I think the divorce laws are pretty strict in Switzerland. However, I can see a point in quietly moving money into crypto, as long as it can be done without showing up on the bank account.

The best time to act was 2””4 years ago. The second best time to act is today.

Once the divorce is filed or could reasonably be assumed to be filed imminently, it's too late. Anything you do then risks to being considered fraudulent, which could cost far more than the just the divorce would.

So it depends on what the current situation is.

It's very hard to prove fraud, and if the state is not the victim don't expect the prosecutor to pay too much effort in the exercise.

Not necessarily, but we don't know what the “good reserve” amounts to.

Your friend has been screwed the moment he signed the contract with wife.
It's time for a reality check. He should move quick and be safe. Perhaps he could also try to reach an agreement with wife, and explain her that the only winner in court battles is the state (and the lawyers in second place).

Agreed, it would likely have to be a civil matter. For the right amounts and with good lawyers involved, that can be just as bad as prosecution.

If he has to pay x and does something stupid that incurs a penalty of y, the amount to pay is x+y which will either be higher than x unless y is zero.

is something that is really possible, especially with a proper assistance. Common divorce lawyers are usually not too good in that, they are too much focused at confrontation. An experienced professional negotiator can help; and many times it is worth to consider engaging a mediator.
Would you mind sharing what part of Switzerland we are talking about? (DE,FR,IT,RR ”“ eventually, I might be able to direct your friend to someone.)

Assuming there is still time, what could be done? maybe investing in some less structured country?

IMO ”“ no. As @JohnnyDoe and @uplana have said: go for a properly picked cryptocurrency (e.g. XMR), as of 1) fiat is traceable in fact anywhere, 2) “less structured countries” are usually not safe harbours.
