This is not a loophole, this implies that you aren't managing and operating your own comapany from Thailand because in that case it's local sourced income so the remitting part doesn't matter.

You can believe that you aren't the agent but if you are the only one managing and operating the company you are responsabile for the sales so you are the agent, like it or not.

How high are the chances of getting caught?

Probably low but you need to be aware that you aren't compliant and accept the risks involved.

You are right.
At the end of the day, we always get back to rules enforcement.

When doing business anywhere except the western oppressing world:
- 1st be aware of the comprehensive and up-to-date laws related to your business.
- 2nd know which rules are truly enforced and the ones that aren't.
- 3rd make sure of what you are really risking and how you can mitigate/dismiss penalties.
Then decide accordingly.

When rules change just adapt or die move on.

To each their own but in my opinion striving hard to comply with constantly unenforced law is as unproductive as a complete waste of time/energy.
